Terms of Use
These Terms of Use (“Terms”) govern your use of the Drealm app for iPhone (“Drealm”, “the app”) and the website drealm.app, provided by Valentyn Khutornenko (“we”, “us”). By downloading or using the app, you agree to these Terms. If you don’t agree, please don’t use the app.
1. Apple’s license terms
The app is licensed to you under Apple’s Licensed Application End User License Agreement (“Apple EULA”). These Terms supplement the Apple EULA. If they conflict, the Apple EULA prevails to the extent required by Apple’s App Store terms.
2. What Drealm is
Drealm is a tool for personal motivation and visualisation: it helps you collect images and words that represent your goals and look at them regularly. Drealm doesn’t provide medical, psychological, financial or other professional advice, and we don’t guarantee any particular result from using it.
3. Your content
You keep all rights to the photos, videos, text and other content you add to the app (“your content”). Your content is stored on your device and, if you enable sync, in your private iCloud. We don’t receive it and we don’t claim any rights to it.
You are responsible for your content and for having the rights to use it. Please keep backups of anything important: if you delete the app or your iCloud data, your content may be lost.
4. Subscriptions
Some features are available only with a Drealm Premium subscription. The available plans, their prices and billing periods are shown in the app before you buy.
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. The renewal is charged within 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your Apple Account settings. Cancellation takes effect at the end of the current period.
- If a plan includes a free trial, you won’t be charged until the trial ends, unless you cancel before that. Any unused part of a free trial is forfeited when you buy a subscription.
- Purchases are processed by Apple. Refunds are handled by Apple according to its policies and can be requested at reportaproblem.apple.com.
- If a subscription price changes, Apple will notify you in advance and, where required, ask for your consent.
You can restore previous purchases on the same Apple Account using “Restore purchase” in the app.
5. Acceptable use
You agree not to use the app to store or share unlawful content, not to attempt to copy, modify, reverse engineer or resell the app except as permitted by law, and not to interfere with the app or the services it relies on.
6. Third-party content and services
Images found through the app’s photo search are provided by Unsplash and are subject to the Unsplash License. The app also relies on third-party services described in our Privacy Policy. Their use is governed by their own terms, and we are not responsible for third-party content or services.
7. Intellectual property
The app, its design, illustrations, texts and trademarks belong to us or our licensors. Except for the license granted to you under the Apple EULA, no rights are transferred to you.
8. Disclaimer
The app is provided “as is” and “as available”. To the extent permitted by law, we make no warranties, express or implied, including that the app will be uninterrupted, error-free or meet your expectations.
9. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of or inability to use the app. Our total liability for any claim related to the app is limited to the amount you paid for the app or subscription in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Termination
You can stop using the app at any time by deleting it and cancelling any active subscription. We may suspend or end your access to the app if you seriously breach these Terms.
11. Governing law
These Terms are governed by the laws of Ukraine. If you are a consumer, you also keep the protection of mandatory laws of the country where you live, and you can bring claims in the courts of that country.
12. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and change the effective date above. If you keep using the app after the changes take effect, you accept the updated Terms.
